The outcome of the relationship between Commonwealth benefits and compensation paid by the Board is directly attributable to Commonwealth legislation and policy. The Dust Diseases Board has no control over how your Commonwealth benefits may be affected by compensation payments from the Dust Diseases Board.
Commonwealth Government Departments will often contact the Board to request details of an individual's workers' compensation entitlements. Under Commonwealth legislation, the Board is obliged to provide this information if requested.
Some Commonwealth legislation (for example the Social Security Act) contains a clause that requires individuals who may have a compensation entitlement to pursue their claim. If an individual does not pursue this claim the Commonwealth may reduce or suspend your pension or benefit.
